All information that is provided in the framework of the Internet presentation – hereinafter called website – of the company Compumatica secure networks GmbH and Compumatica secure networks BV – hereinafter called Compumatica – is subject to the following exclusion of liability:

1. Content

All information made available on the Compumatica website has been carefully chosen and compiled. In spite of this, we do not assume any responsibility for the actuality, correctness, completeness, or quality of the provided information. Compumatica does not accept any liability for damages, be it material or ideal, that arise from the utilization or non-utilization of the information provided, respectively from the utilization of inaccurate or incomplete information. Exempt from this are only damages that were caused intentionally or through gross negligence. All offers are subject to change and without obligation. Compumatica reserves the right to modify, supplement, or delete parts of or the complete website without prior notice, or to suspend the publication temporarily or ultimately. All information is intended for personal use; commercial use is not permitted.

According to Art.5, Sec.1, of the German telecommunications law as of 22/07/97 (TDG), Compumatica is only responsible for the utilization of its own contents made available for public use. This responsibility does not extend to third-party information that is accessible by means of cross-references ("hyperlinks"). Compumatica is only liable for possibly illegal respectively criminal contents of third parties if Compumatica definitely knew about it and if it was technically feasible and reasonable to prevent the use of these contents (according to Art.5, Sec.2 TDG). As hyperlinks do not refer to static information but instead to possibly changing information of third parties, Compumatica cannot provide a permanent assessment of this information. Compumatica made sure when a link was initially established that the contents were neither relevant under criminal nor civil law aspects. However, according to the TDG Compumatica is not obliged to reassess the innocuousness of the linked third parties' information permanently. If Compumatica notices modifications to linked third parties' information, or if Compumatica is informed about modifications, Compumatica will delete the reference immediately as far as this is technically procurable and reasonable. On no account will Compumatica adopt linked information as its own.

3. Copyright

Compumatica intends to observe the copyrights of all images, graphics, texts, audio and video clips used in any publication, to display as many self-created images, graphics, texts, audio and video clips as possible, or to resort to license-free images, graphics, texts, audio and video clips. All brand and trade marks named on the Compumatica website that are possibly protected by third parties are the unlimited subject to the regulations of the respective valid laws of labeling and rights of ownership of the respective registered proprietors. The mere mention alone does not permit the conclusion that brand marks are not protected by rights on the part of third parties. The copyright for images, graphics, texts, audio and video clips published and created by Compumatica itself remains with Compumatica. The distribution or use of such images, graphics, texts, audio and video clips in other electronic or printed media is not allowed without the explicit consent of Compumatica.

4. Privacy

Personal data submitted on the Compumatica website such as postal addresses, telephone and fax numbers as well as e-mail addresses must not be utilized by others for the transmission of information which has not been explicitly requested.

5. Legal effect of this disclaimer

This disclaimer is part of the Compumatica website. If parts or individual phrases of this document do not comply with the current legal situation anymore, partially or completely, the content and the validity of other parts of this disclaimer remain unaffected.

Use and disclosure of personal data and restrictions as to purpose
We use your personal data only for the purposes stated on this information page about data protection. In addition, personal data will only be recorded, processed or used by us if it is necessary according to a careful assessment of all the interests relating to the maintenance of the legitimate business interests of Compumatica secure networks.
We will disclose the personal data that you have disclosed to us without your express consent to subsidiaries or business partners involved only to the extent that it is necessary to process your order, but not disclose them to other third parties and in particular not sell them or otherwise pass them to commercial user.

General Terms and Conditions

The following General Terms and Conditions apply for any business (sale, license, maintenance) with Compumatica secure networks. For your convenience a translation of the German General Terms and Conditions was made by Compumatica, however, in case of doubt the German version shall take precedence. If you do business with a foreign subsidiary of Compumatica secure networks, the general terms and conditions of the corresponding subsidiary apply.

Disposal of Compumatica appliances

For the disposal of equipment purchased from us you can return it via our RMA process. RMA stands for Return Materials Authorization, i.e. "authorized return". To ensure the correct operational procedure we kindly ask you to use the link RMA. Shipping costs are for your own account.
